Trade Mark Searching
Full availability searches in Australia are conducted. These include limited common law enquires to check if a third party may be using the same or similar unregistered trade mark in which it may have accrued rights at common law.
Trade Mark Applications
In the majority of cases, applications are filed electronically in order to streamline the process. In Australia there is a two step process for the payment of fees. A fee is payable upon filing an application, and a further fee is payable once the application has cleared the examination process and has been accepted for registration. All fees are dependant on the number of classes covered in the application.

Trade Mark Counsel For a Day (TMC For a Day™) - [Australia only]
For a fixed sum, one of our professionals will work out of your offices on your trade mark matters or to train your staff on trade mark searching or filing. Simply think of us as a member of your in-house team who you can look to as and when required. In the Melbourne area our TMC for a Day™ services are available for half or full day bookings. For country or interstate clients we are available for a minimum booking of two days.
Costs
We take great pride in providing superior levels of service while remaining cost conscious. We also take care to ensure our prices are competitive in the marketplace.
If you bring us a written quote from one of our competitors for an Australian or New Zealand trade mark application, we will do our best to match their price, if not better it. Unfortunately we are unable to extend this offer to international trade marks as costs, such as associate’s fees and currency fluctuations, are out of our control.
As a general rule, from application to registration the cost for a straightforward Australian trade mark application in one class will be in the region of $1500. Extra costs do apply for responding to Examiner’s reports or if there is more than one class in the application. We are happy to provide a discount in the case of multiple filings at the same time or if a number of classes are covered.
